Welcome to Apex Suite. These Terms of Service (“Terms,” “Agreement”) govern your access to and use of the Apex Suite website, software, and related services (“Services”). By creating an account or using Apex Suite, you agree to these Terms. If you do not agree, do not use the Services.
1. Use of Services
Eligibility
You must be 18 years or older and legally able to enter into binding agreements to use Apex Suite.
Account Responsibility
You are responsible for keeping your login information secure and for all actions taken under your account. If you believe your account has been compromised, email us at [email protected].
Permitted Use
You agree not to misuse Apex Suite, including but not limited to:
Attempting to access data that does not belong to you
Copying, reverse-engineering, or reselling our software
Sending unlawful, abusive, fraudulent, or unsolicited messages
Apex Suite offers messaging tools. You are solely responsible for ensuring that all messages sent from your account comply with all applicable laws and carrier rules, including TCPA, CTIA, FCC regulations, A2P 10DLC requirements, and CAN-SPAM for email.
Consent
You must obtain valid consent before sending messages to recipients.
Opt-Out Requirements
All SMS messages must support the following: STOP – to unsubscribe HELP – for assistance Standard rates may apply.
All payments are non-refundable except in cases of billing errors or duplicate charges.

Your use of Apex Suite is also governed by our Privacy Policy.
Data Ownership
You retain ownership of your uploaded data, contacts, and content. Apex Suite only uses your data to provide services.

Illegal or fraudulent activity
Excessive spam complaints or carrier issues
Repeated failed payments
Upon termination, access to your data may be limited or removed.
9. Limitation of Liability
Apex Suite is provided “as is.” To the fullest extent allowed by law:
We are not liable for indirect, incidental, or consequential damages
Total liability for any claim will not exceed the amount paid by you in the previous 12 months

You agree to indemnify and hold Apex Suite harmless from any claims, damages, or losses arising from:

Your messages or content
Your violation of laws or these Terms
11. Changes to These Terms
